Tilly Norwood And AI Confusion Will Shape Looming Guild Talks, Top Copyright Lawyers Say

In the looming contract talks between Hollywood studios and above-the-line unions, confusion around AI and issues raised by the debut of synthetic actress Tilly Norwood are certain to be key themes.

“The negotiating cycle is starting and the DGA is probably negotiating their contract within a month,” said Jonathan Handel, an entertainment and technology lawyer at Feig/Finkel. SAG-AFTRA and the WGA are also also heading into negotiations ahead of the mid-2026 expiration of their current contracts with studios and streamers, with the wounds barely healed from the dual strikes of 2023.

Norwood, whose arrival last month stirred up an industry tempest, is “a difficult situation,” Handel added, “and the union did not get anything on completely synthetic characters in the last round. So maybe they will this time.”

Handel and Mishawn Nolan, managing partner of intellectual property law firm Nolan Heimann, shared their perspectives during a panel Friday afternoon at Infinity Festival in Los Angeles.

Digital scanning of human actors, for the purposes of using their likenesses in film and TV projects is another tricky area for the unions given how untested the legal questions are, the attorneys agreed.

“I actually have a client right now,” Nolan said, whose body is being scanned. “What I received [from the company] was just a sort of standard certificate of engagement. It was all rights, just like you would normally use. And I said, ‘Well, what are you gonna do with the data? What is the scope of the use?’”

Because of the intense pressure on productions to move quickly, Nolan said, “everyone would like to just turn around [a talent agreement] tomorrow.” But the complexities of copyright issues raised by AI, which is evolving at a breakneck clip, require a lot more thought, she argued. “The way that we’ve always done business can’t be done in the future. It can’t be done instantaneously,” she continued. “You have to take a moment and think about, what are you doing? What are you capturing? What are you going to use it for? How are you going to use it? How long are you going to have access to it? And what happens in the long term? Who holds onto it? Is it safe? Is it gonna be destroyed?”

The scanning of human actors, Handel said, “very much implicates what SAG-AFTRA negotiated” in its last contract, and insisting on the data being destroyed isn’t necessarily a solution. “Twenty years from now, the company may say to the celebrity, ‘You know, we really like to do a reboot of that thing with you de-aged, but the ideal de-aging is actually the data from when you were younger,’” he posited. “And the celebrity might say no, or the celebrity might say, ‘Hey, that’s great, more money for me, and I’m gonna reboot my career.’ And then they’re like, ‘Oh fuck, my talent lawyers insisted that you throw away the data. So we don’t have the data anymore.’ But on the other hand, you don’t want the necessarily want the production company or studio to have the right to store the data indefinitely.”

Another vexing area is the trove of unproduced screenplays whose copyrights are owned by studios and streamers. They could potentially be used to train AI models, Handel said. “The union agreements, as of two, two-and-a-half years ago, did not address, ‘Hey, what about retroactivity?’ That may come up in the in the current situation. It’ll be very hard fought because, you know, it’s obviously a big potential source of monetization for the companies, but also something that, OK, well, if you’re going to do that, just like when you rerun a movie, you’ve got to pay residuals.”

The use of generative AI tools in production is also problematic, Handel and Nolan noted. There are different copyright issues facing the input (text submitted to a model like OpenAI’s Sora, for example) and output (the video that is produced as a result.)

“The trouble and the confusion is that the technology and the workflow have advanced so quickly and are gonna continue to advance,” Handel said. There can be hundreds of prompts, and revisions of prompts, resulting in video sequences with some resemblance to protected work, but the eye is sometimes in the beholder. “That is going to force at some point more nuanced court decisions, and it’s going to be very difficult to figure out, you know, where’s the line?” he said.

Media giants like Disney, NBCUniversal and Warner Bros. Discovery have sued various AI players in order to enforce their copyrights. OpenAI’s Sora 2, introduced less than two weeks ago, has created an uproar that some stakeholders believe will only die down once lawsuits are filed there as well.

It all adds up to a business environment defined by profound uncertainty, Nolan said.

“The way that you’ve operated for the past year, the past five years, the past 10 years, you cannot assume that that is the business environment in which you can operate moving forward,” she said. “A lot of the foundations and assumptions that you have been relying on, you cannot rely on them moving forward.”

One example is the tried-and-true staple of all contract law: the multi-year agreement. “How do you do a five-year deal when the law and the technology can be different next week?” Nolan asked.

Hollywood is facing a new kind of star power with “AI actor” Tilly Norwood, who doesn’t exist outside of code — and she’s already negotiating with talent agencies.

Norwood is a character made entirely by artificial intelligence, dubbed Hollywood’s first “AI actor.” She is the product of a company named Xicoia, which bills itself as the world’s first artificial intelligence talent studio.

Since Dutch producer and comedian Eline Van der Velden launched the digital character’s prospective career, Norwood has been the talk of Hollywood.

Earlier this month, Van der Velden, founder of the AI production studio Particle6, promoted Norwood at the Zurich Summit, the industry sidebar of the Zurich Film Festival. She said Norwood was in talks with talent agencies and that she expected to announce a signing soon.

“We were in a lot of boardrooms around February time, and everyone was like, ‘No, this is nothing. It’s not going to happen.’ Then, by May, people were like, ‘We need to do something with you guys,” Van der Velden told Deadline’s Diana Lodderhose.

“When we first launched Tilly, people were like, ‘What’s that?’ and now we’re going to be announcing which agency is going to be representing her in the next few months.”

But not everyone is excited about Norwood potentially signing with a talent agency.

In a statement Tuesday, the Screen Actors Guild said that “creativity is, and should remain, human-centered.”

“To be clear, ‘Tilly Norwood’ is not an actor, it’s a character generated by a computer program that was trained on the work of countless professional performers — without permission or compensation,” the guild said. “It has no life experience to draw from, no emotion and, from what we’ve seen, audiences aren’t interested in watching computer-generated content untethered from the human experience.”

“Hope all actors repped by the agent that does this , drop their a$$,” In The Heights actor Melissa Barrera wrote on her Instagram Stories. “How gross, read the room.”

“Any talent agency that engages in this should be boycotted by all guilds. Deeply misguided & totally disturbed,” Natasha Lyonne wrote on Instagram.

Emily Blunt spoke about Norwood during an episode of the Variety Awards Circuit Podcast, referring to the idea of an AI actor as “terrifying.”

“Does it disappoint me? I don’t know how to quite answer it, other than to say how terrifying this is,” Blunt said.

When Blunt was shown a photo of Norwood, she said, “No, are you serious? That’s an AI? Good Lord, we’re screwed. That is really, really scary. Come on, agencies, don’t do that. Please stop. Please stop taking away our human connection.”

Blunt also suggested that Norwood’s creators want her to be “the next Scarlett Johansson.”

“But we have Scarlett Johansson,” she added.

Whoopi Goldberg opened up about her thoughts on Norwood during Monday’s episode of The View.

“The problem with this, in my humble opinion, is that you’re up against something that’s been generated with 5,000 other actors. It’s been given all of these — it’s got Bette Davis’s attitude … it’s got my humour,” she began.

“It’s a little bit of an unfair advantage. But you know what? Bring it on,” Goldberg said. “Because you can always tell them from us.”


In response to the backlash, Van der Velden shared a statement on Norwood’s Instagram, writing, “To those who have expressed anger over the creation of our AI character, Tilly Norwood: she is not a replacement for a human being, but a creative work – a piece of art.”

“Like many forms of art before her, she sparks conversation, and that in itself shows the power of creativity,” Van der Velden continued. “I see AI not as a replacement for people, but as a new tool – a new paintbrush. Just as animation, puppetry, or CGI opened fresh possibilities without taking away from live acting, AI offers another way to imagine and build stories.”

Van der Velden, who is also an actor, said that nothing can take away “the craft or joy of human performance.”

“Creating Tilly has been, for me, an act of imagination and craftsmanship, not unlike drawing a character, writing a role or shaping performance. It takes time, skill, and iteration to bring such a character to life,” she wrote. “She represents experimentation, not substitution. Much of my work has always been about holding up a mirror to society through satire, and this is no different.”

Van der Velden said she believes that AI characters should be judged as part of their own genre and on their own merits rather than compared directly with “human actors.”

“Each form of art has its place, and each can be valued for what it uniquely brings. I hope we can welcome AI as part of the wider artistic family: one more way to express ourselves, alongside theatre, film, painting, music, and countless others,” she wrote. “When we celebrate all forms of creativity, we open doors to new voices, new stories, and new ways of connecting with each other.”

Artificial intelligence is often used as a tool in film production, though its implementation is hotly debated. It was a major bargaining point in the lengthy strike by SAG-AFTRA that concluded in late 2023, with some safeguards put in place to protect the use of actors’ likenesses and performances by AI.

Tilly Norwood, who is recognized as Hollywood’s first AI-generated actress, has become the subject of discussion within the creative community. Developed by Eline Van der Velden and her company, Particle6, Tilly is a computer-generated “girl next door” who has attracted a growing fanbase and interest from talent agencies.

 

Van der Velden mentioned to an industry panel in Switzerland that studios and entertainment companies are quietly embracing AI technology, which her company believes can significantly reduce production costs. She said, “When we first launched Tilly, people were like, ‘What’s that?’, and now we’re going to be announcing which agency is going to be representing her in the next few months.”


Tilly Norwood has appeared in a short sketch, and it is expected that she will become a prominent figure in the entertainment industry. Van der Velden said, “We want Tilly to be the next Scarlett Johansson or Natalie Portman, that’s the aim of what we’re doing. People are realizing that their creativity doesn’t need to be boxed in by a budget,  there are no constraints creatively and that’s why AI can really be a positive.”

 

The arrival of Tilly Norwood, however, has been met with some criticism from Hollywood actors and creative professionals. The use of artificial intelligence in the entertainment industry was a major point of discussion during the 2023 writers’ and actors’ strikes.

 

Actress Melissa Barrera criticised talent agents who are promoting AI actors, and she encouraged her fellow actors to refrain from supporting them.

 

On the other hand, Mara Wilson, who was the child star in Matilda, highlighted the ethical concerns about Tilly’s creation. She questioned, “What about the hundreds of living young women whose faces were composited together to make her? You couldn’t hire any of them?”

 

Regarding the criticisms, Van der Velden shared Tilly’s post defending her creation. She said, “She is not a replacement for a human being, but a creative work – a piece of art. Like many forms of art before her, she sparks conversation, and that in itself shows the power of creativity.”

‘Tilly Norwood’ Is Not an Actor

SAG-AFTRA has released a statement September 30 roundly condemning artificial intelligence talent studio Xicoia’s shopping of an AI actor named Tilly Norwood to the industry.

News broke from Deadline at the Zurich Summit on September 27 that Hollywood talent agents have been quietly circling Norwood for representation. For the past five months, Xicoia, launched by Dutch technologist Emily Van der Velden as part of her company Particle 6 Productions, has been soft-launching Norwood on Instagram.

The studio has been posting headshots, candids, and even motion graphics of the AI performer, who takes the form of a dewy teenage girl who is supposed to live in London. Just in the past week, Xicoia has posted hypothetical, AI-generated screenshots of Norwood in a kind of digital portfolio showing the different film projects she could appear in: There’s one of her in a dimly-lit thriller scenario, one of her on a subway (do AI characters need public transportation?), and one of her in a warm, candle-lit period romance setting where she appears to be having an emotional heart-to-heart with an object of her affection, her furrowed brow conveying anguish.

Needless to say, SAG-AFTRA sees this as an existential threat.

“SAG-AFTRA believes creativity is, and should remain, human-centered. The union is opposed to the replacement of human performers by synthetics,” the statement from the union began.

“To be clear,” the statement continued, “‘Tilly Norwood’ is not an actor, it’s a character generated by a computer program that was trained on the work of countless professional performers — without permission or compensation. It has no life experience to draw from, no emotion and, from what we’ve seen, audiences aren’t interested in watching computer-generated content untethered from the human experience. It doesn’t solve any ‘problem’ — it creates the problem of using stolen performances to put actors out of work, jeopardizing performer livelihoods and devaluing human artistry.”

“Additionally, signatory producers should be aware that they may not use synthetic performers without complying with our contractual obligations, which require notice and bargaining whenever a synthetic performer is going to be used.”

Since the Deadline report, the existence of Norwood has rankled many in Hollywood, including Melissa Barrera, who posted on Instagram, “Hope all actors repped by the agent that does this, drop their a$$. How gross, read the room.”

Actor and model Michael Aurelio tweeted, “Pretty telling that the industries first venture into this was to create a teenage girl they could control.”

For her part, Van der Velden responded to the growing backlash by writing on Instagram, “To those who have expressed anger over the creation of my AI character, Tilly Norwood, she is not a replacement for a human being, but a creative work — a piece of art. Like many forms of art before her, she sparks conversation, and that in itself shows the power of creativity.”

“I see AI not as a replacement for people, but as a new tool, a new paintbrush. Just as animation, puppetry, or CGI opened fresh possibilities without taking away from live acting, AI offers another way to imagine and build stories. I’m an actor myself, and nothing — certainly not an AI character — can take away the craft or joy of human performance.”

Newly-launched AI talent studio Xicoia have created the digital performer, with Eline Van der Velden unveiling the project at the Zurich Film Festival and it already attracting interest from talent agents, and the Smashing Machine actress is horrified by the prospect.

Shown a report on Tilly, Emily told Variety: “Does it disappoint me? I don’t know how to quite answer it, other than to say how terrifying this is.

“No, are you serious? That’s an AI? Good Lord, we’re screwed. That is really, really scary, Come on, agencies, don’t do that. Please stop. Please stop taking away our human connection.”

The 42-year-old actress noted Tilly was designed to resemble a composite of familiar stars and was told she was designed as “the next Scarlett Johansson”.

She replied: “But we have Scarlett Johansson.”

Emily isn’t the only Hollywood critic of the project.

Scream actress Melissa Barrera has branded the arrival of Tilly “gross”.

She posted an Instagram Story about the news and captioned it: “Hope all actors repped by the agent that does this, drop their a$$. How gross, read the room.(sic)”

Matilda star Mara Wilson was equally horrified.

She posted: “And what about the hundreds of living young women whose faces were composited together to make her? You couldn’t hire any of them?”

Whoopi Goldberg blasted the idea on The View and insisted the AI model would have an “unfair advantage” – but noted the technology isn’t yet “seamless” enough for them to pass as human.

She said: “The problem with this, in my humble opinion, is that you are suddenly up against something that’s been generated with 5,000 other actors.”It’s got Bette Davis’ attitude, it’s got Humphrey Bogart’s lips.

“It’s got my humour, thank you darling. And so it’s a little bit of an unfair advantage. You know what? Bring it on. You can always tell them from us. We move differently, our faces move differently, our bodies move differently…

“Hopefully, we’ll be able to hold on because what this means is AI in the workplace — not just my workplace, but in every industry.

“Some industries are using AI now. People talk about people are so lonely they don’t have a connection, if you stick with this, with AI, you won’t have any connection to anything but your phone.”

Simu Liu also condemned the project.

He sarcastically wrote on his Instagram Story: “Movies are great but you know what would be better is if the characters in them weren’t played by actual humans but by AI replicas approximating human emotion.”

Creator Eline insisted Tilly is “a piece of art” and she doesn’t view AI as a “replacement” for real people.

She wrote on Instagram: “To those who have expressed anger over the creation of my AI character, Tilly Norwood, she is not a replacement for a human being, but a creative work – a piece of art. Like many forms of art before her, she sparks conversation, and that in itself shows the power of creativity.

AI Actress Tilly Norwood Attracts Interest From Talent Agents

AI actress Tilly Norwood has attracted the attention of multiple talent agents, actor, comedian and producer Eline Van der Velden told a panel at the Zurich Summit, the industry strand of the Zurich Film Festival.

Tilly Norwood is the first creation to emerge from recently launched AI talent studio Xicoia, a spin-off from Van der Velden’s AI production studio Particle6.

Van der Velden said that studios were quietly moving forward with AI projects, and that further announcements would come in the next few months.

“We were in a lot of boardrooms around February time, and everyone was like, ‘No, this is nothing. It’s not going to happen.’ Then, by May, people were like, ‘We need to do something with you guys,’” said Van der Velden, who was being interviewed on stage Saturday by Diana Lodderhose of Deadline.

“When we first launched Tilly, people were like, ‘What’s that?,’ and now we’re going to be announcing which agency is going to be representing her in the next few months.”

In July, Norwood revealed on her Facebook page that she had appeared in her first role, a comedy sketch “AI Commissioner,” which can be found below.

Norwood wrote, “Can’t believe it… my first ever role is live! I star in ‘AI Commissioner,’ a new comedy sketch that playfully explores the future of TV development produced by the brilliant team at Particle6 Productions.”

She added, “I may be AI generated, but I’m feeling very real emotions right now. I am so excited for what’s coming next!”

“We want Tilly to be the next Scarlett Johansson or Natalie Portman, that’s the aim of what we’re doing,” van der Velden told Broadcast International.

“People are realizing that their creativity doesn’t need to be boxed in by a budget – there are no constraints creatively and that’s why AI can really be a positive,” Van der Velden continued. “It’s just about changing peoples’ viewpoint.”

Particle6 has produced content across multiple genres, from “Miss Holland” for BBC Three to “True Crime Secrets” for Hearst Networks, and “Look See Wow!” for Sky Kids.

Actor, comedian technologist Eline Van der Velden has revealed that her recently launched AI talent studio Xicoia is in talks with a number of talent agents interested in signing its first creation, AI actress Tilly Norward.

Van der Velden talked about the development on a panel at the Zurich Summit on Saturday, where she gave a presentation on her AI production studio Particle6 and then joined a discussion on AI developments in the entertainment industry alongside Verena Puhm, head of Luma AI’s new Studio Dream Lab LA.

Both Van der Velden and Puhm suggested that studios and other media and entertainment companies were quietly embracing AI under the radar, and to expect public announcements about high-profile projects using the technology in the coming months.

“We were in a lot of boardrooms around February time, and everyone was like, ‘No, this is nothing. It’s not going to happen’. Then, by May, people were like, ‘We need to do something with you guys.’ When we first launched Tilly, people were like, ‘What’s that?’, and now we’re going to be announcing which agency is going to be representing her in the next few months,” said Van der Velden.

The revelation of a possible agent signing for Tilly Norward comes just days after Van der Velden officially announced the creation of Particle6 offshoot Xicoia, an AI talent studio designed to create, manage and monetize a new generation of hyperreal digital stars. 

If the talent agency signing comes to pass, Norwood will be one of the first AI generated actresses to get representation with a talent agency, traditionally working with real-life stars.

Former AI artist Puhm, whose appointment as head of startup Luma AI’s new Studio Dream Lab LA was announced in July, concurred with Van der Velden on the mood changing at the studios.

“I remember having meetings with the studios as an AI artist before joining Luma. Some said, ‘Oh, no, we’re not using AI.’ I knew some were lying, they were already secretly working on some stuff, but some were not open to it at all. Then definitely this year, kind of like March, April, people called me and wanted to talk to me,” she said.

“They were discussing me being a liaison between directors and the AI artists… at that time I was traveling around a lot and educating about workflows and pipelines and how it can be integrated, and then all a sudden that was becoming very interesting to them. It was a different language to them and they were like, ‘We really have to get people from the outside that have worked in the AI industry’.

“Historically, the studios have been very slow to adapt, at least publicly, they need that influx of new creatives, and new creative technologists to come in and actually show them how it’s done. You can assume that a lot of them are already working on it.”

Puhm said all the big companies and studios were working on AI assisted projects but being under NDA, she was not in a position to announce any of the details.

“We really want to make them feel comfortable through their testing, through their projects, and working on real projects… we want it to be their decision on when they want to say it out loud, but honestly, I think this year is going to be interesting. In the beginning of next year, there’s going to be a lot of announcements.”
