Trump Refiles Defamation Lawsuit Against NY Times Seeking $15 Billion

Lawyers for President Donald Trump refiled a defamation lawsuit Thursday against the New York Times, with a complaint that is less than half as long as the previous one — after a judge spiked the president’s initial lawsuit for being “tedious and burdensome.” As before, Trump’s refiled complaint seeks an astronomical $15 billion in damages.

The New York Times, in a statement Thursday, reiterated its position that Trump’s lawsuit was meritless and said that “nothing has changed” with the new filing.

“As we said when this was first filed and again after the judge’s ruling to strike it: this lawsuit has no merit,” a Times spokesperson said in a statement. “Nothing has changed today. This is merely an attempt to stifle independent reporting and generate PR attention, but the New York Times will not be deterred by intimidation tactics.”

Trump last month sued the Times, several of its reporters and Penguin Random House (publisher of the book “Lucky Loser” by two Times reporters), alleging that their reporting about the president’s finances and business career defamed him. The suit was filed in the U.S. District Court for the Middle District of Florida. A few days later, a federal judge threw out Trump’s suit, calling it “tedious and burdensome” and saying that a complaint is not “a protected platform to rage against an adversary.” In the ruling, Judge Steven D. Merryday gave Trump’s lawyers 28 days to refile the suit, ordering that the amended complaint be no more than 40 pages long and that it “accord with the rules of procedure.”

Trump’s refiled complaint is 40 pages (available at this link), less than half the original 85-page complaint. The new filing is shorter, but the main arguments are the same.

“As set forth below, Defendants originated and distributed these publications, and the defamatory statements about President Trump therein, with actual malice,” the revised complaint says. “The statements in question wrongly defame and disparage President Trump’s hard-earned professional reputation, which he painstakingly built for decades as a private citizen before becoming President of the United States, including as a successful businessman and as star of the most successful reality television show of all-time — The Apprentice.”

In his previous ruling finding Trump’s lawsuit “decidedly improper and inadmissible,” Merryday said that several statements in Trump’s initial complaint were unnecessary to make the president’s case. For example, he wrote, “in one of many, often repetitive, and laudatory (toward President Trump) but superfluous allegations, the pleader states, ‘The Apprentice’ represented the cultural magnitude of President Trump’s singular brilliance, which captured the [Z]eitgeist of our time.”

Trump’s suit seeks compensatory damages of at least $15 billion as well as punitive damages, as well as a “retraction of the defamatory publications and statements” from the New York Times and Penguin Random House.

Separately, Trump this summer sued the Wall Street Journal, its parent companies Dow Jones and News Corp, Rupert Murdoch and two Journal reporters, alleging defamation over a WSJ story with details about a birthday letter Trump sent in 2003 to Jeffrey Epstein. According to the lawsuit, Trump is demanding “not less than $10 billion” on two counts of defamation, for at least $20 billion total. Last month, lawyers for the Wall Street Journal filed a motion to dismiss the suit, saying that Trump’s suit should be thrown out because the WSJ article in question “is true,” noting that in response to a congressional subpoena, “Epstein’s estate produced the Birthday Book, which contains the letter bearing the bawdy drawing and [Trump’s] signature, exactly as The Wall Street Journal reported.”

Among other litigation, Trump also sued ABC News and CBS News’ “60 Minutes” and reached separate $16 million settlements in each of those cases.

Recapping “perhaps the most infamous rap battle in the genre’s history,” Vargas noted that before Not Like Us, Drake mocked Lamar’s height and shoe size and questioned his success in an April 2024 track called Push Ups, while Lamar insulted Drake’s fashion sense that same month in Euphoria.

From there, Vargas wrote, the insults escalated, becoming “vicious, personal.”

The judge said she considered the forum in which the insults occurred and concluded that the average listener does not think a diss track “is the product of a thoughtful or disinterested investigation, conveying to the public factchecked verifiable content.”

Not Like Us — described by Vargas as having a “catchy beat and propulsive bassline” — was one of 2024’s biggest songs.

The lawsuit went on to detail a shooting at Drake’s home a few days after the song was released, resulting in a security guard being seriously injured.

“During the nearly 30 minutes it took for the ambulance to arrive, Drake and others laboured to keep the man alive by applying pressure to the gunshot wound with towels. Blood was everywhere,” the filing read.

According to the suit, nothing like that had happened to Drake or his family during the two decades that he had been working in the music industry.

The lawsuit also stated that the multiple break-in attempts on his home that happened following the release of the song were caused by UMG’s actions.

“With the palpable physical threat to Drake’s safety and the bombardment of online harassment, Drake fears for the safety and security of himself, his family, and his friends,” according to the suit.

Drake’s team made it known that the lawsuit was not directed at Lamar and clearly placed the blame on Universal for releasing, distributing and promoting the song.

“This lawsuit is not about the artist who created Not Like Us,” the suit read. “It is, instead, entirely about UMG, the music company that decided to publish, promote, exploit, and monetize allegations that it understood were not only false, but dangerous.”

The feud between Drake and Lamar is among the biggest in hip-hop in recent years, with two of the genre’s biggest stars at its centre.

The two were occasional collaborators more than a decade ago, but Lamar began taking public jabs at Drake starting in 2013. The fight escalated steeply earlier last year.

Kim Kardashian and Kris Jenner have moved to file a lawsuit against Ray J after he allegedly defamed them with allegations of a federal investigation.

According to the Associated Press, the mother-daughter duo filed in Los Angeles Superior Court on Wednesday (Oct. 1) and claimed that Ray J’s most recent claims crossed a line and are part of a  “sustained campaign of harassment and defamation” that has lasted for years.

“Unable to accept the end of his fleeting relationship with Ms. Kardashian over twenty years ago, Ray J has repeatedly sought to attach himself to Plaintiffs’ names and exploit their prominence for personal gain,” the lawsuit detailed.

Last month, audio surfaced of Ray J, legal name Ray Norwood Jr., alleging to have involvement with a federal investigation of the two women.

“This federal RICO though on KK and Kris…the federal RICO I’m about to drop on Kris and Kim is about to be crazy,” he boasted while speaking to Baddies star Chrisean Rock. “I’m talking about, I’m on the news every day. I’m gonna say a lot of sh*t. If anybody know Kim or cool with Kim, they need to tell her now, the rain is coming, the feds is coming….There’s nothing I can do about it.”

According to AP, the lawsuit also noted a TMZ special that aired in May where Ray J proclaimed, “racketeering charges against the Kardashians would be appropriate,” and “if you told me that the Kardashians were being charged for racketeering, I might believe it.”

“No such federal investigation exists; no law enforcement agency has initiated any criminal proceedings or investigations related to racketeering charges against Ms. Kardashian or Ms. Jenner; and no credible evidence whatsoever supports these inflammatory allegations,” explained the lawsuit.

“Ray J’s acknowledged animosity toward the Kardashian family, coupled with his demonstrated willingness to lie for attention, leaves no room for doubt that his recent RICO statements were neither careless nor impulsive,” the lawsuit continued. “They were the latest salvo in a deliberate and malicious campaign of harassment and defamation intended to defame Plaintiffs while reviving his own fading notoriety.”

In response, Ray J alleged that the family attempted to make him a “slave.” In the above clip taken from a Twitch live stream, the 44-year-old addresses the allegations made in the lawsuit.

A California judge suggested Monday that A$AP Relli should consider dropping his defamation lawsuit against A$AP Rocky before an upcoming ruling that could leave him on the hook for Rocky’s substantial legal fees.

“I would urge you to contact the other side and see if a deal can be made,” Los Angeles County Judge Randolph M. Hammock said at a morning hearing in downtown L.A. “Maybe in exchange for dismissing the lawsuit, they’ll drop their claim for fees. … Maybe it’s time to cut your losses.”

“I’ve already invested over $500,000. I paid [my prior law firm] Sheppard Mullin, and they left me at the last minute. So now, I’m stuck on my own. I’m just fighting for my rights here,” Ephron told Judge Hammock.

Speaking slowly and deliberately, the judge repeatedly tried to break down the legal issues behind Rocky’s pending anti-SLAPP motion. He said the law is so “harsh” that Rocky, born Rakim Mayers, and Tacopina could still seek fees, even if Ephron dismissed his case immediately.

“Mr. Ephron, listen to me carefully, OK? This is a very, highly technical motion. It has to do with the First Amendment,” Judge Hammock said. “They have to [show] this is a matter of public interest. They probably will show that. I’m pretty sure they will. I think your case has gotten some press, okay? And I know that Mr. Mayers was recently acquitted. … Maybe you can reflect upon this case and what you want to do.” The judge said it was still possible he might rule in Ephron’s favor, but again he warned that Ephron was the underdog. He said Ephron might be throwing “good money” after “bad” if he persists.

California’s anti-SLAPP statute was designed to give defendants a way to mount early challenges to frivolous lawsuits seeking to chill their free speech. Defendants bringing the motion must first convince the court that their speech was a matter of public concern. If they can, plaintiffs must then step in and convince the court that they already have ample admissible evidence proving they were defamed, even before any discovery in the case. It’s a high bar, the judge said.

Ephron filed his defamation lawsuit against Mayers and Tacopina in 2023. He claimed the men unfairly branded him a liar and extortionist who was trying to shake down the “Sundress” rapper with the shooting claims. Mayers vehemently denied assaulting Ephron.

During Mayers’ three-week criminal trial, an eyewitness testified that Rocky only had a prop gun firing blanks the night of the confrontation. Jurors also heard a recording in which Ephron told an associate in 2022 that he was willing to “walk away” and hide from prosecutors on an island if Mayers paid him. They also heard Ephron demanded $30 million.

On Monday, Judge Hammock set an Oct. 23 hearing for the anti-SLAPP motion in the defamation case. He said Ephron had to file an opposition before then, whether he finds a new lawyer or not. Ephron also is suing Mayers for civil assault related to the 2021 confrontation. A trial in that case is set for January.

“Rocky has done nothing wrong, and we’re looking forward to a decision,” Mayers’ civil lawyer James Sargent told Rolling Stone after the Monday hearing. He declined to say whether Mayers would be willing to strike a deal with Ephron to waive his right to attorneys fees in the defamation case.

In a filing last month, Mayers’ lawyers wrote that there’s “no question that the alleged statements made by [Tacopina] were done so in a public forum about an issue of public interest.”

“Mr. Mayers is a world-renowned artist who also happens to be in a romantic relationship with one of the most famous women in the world, Rihanna. There is an incredible public interest in Mr. Mayers. This point is underscored by the fact that numerous media publications sought out comments from Mr. Mayers, through Mr. Tacopina, upon both the initiation of criminal charges against him and the subsequent civil lawsuits filed by Plaintiff Terell Ephron,” the civil defense lawyers said. “The general public was incredibly interested in the allegations against Mr. Mayers and his opinion regarding their validity, or lack thereof. The interviews and statements given by Mr. Tacopina on behalf of Mr. Mayers, and himself, absolutely fall under the protection of the anti-SLAPP statute. As such, the defamation claims should be dismissed in their entirety.”

Mayers has long maintained his innocence in the face of Ephron’s claims. He did not testify in his own defense, but two other A$AP Mob members testified that his prop gun came from the set of the “D.M.B.” music video he shot with Rihanna in July 2021. The friends said the prop gun only fired blanks.

When the jury returned its verdict, handing Mayers a resounding victory in his criminal case, the rapper and actor dove over a waist-high courtroom barrier to embrace Rihanna, who was seated in the front row. He then hugged Tacopina and addressed the jurors as they left the courtroom. “Thank you all for saving my life. Thank you. Thank you for making the right decision,” he said.
